Environmental labeling of packaging
From January 1, 2023, Legislative Decree 116/2020, which transposes EU Directives 2018/851-852 on waste, packaging, and packaging waste, and Law No. 15/2022 (Official Gazette No. 49 of February 28, 2022) converting Decree Law No. 228/2021 (the so-called “Milleproroghe Decree”), the obligation to label packaging for environmental purposes is introduced in order to facilitate its collection, reuse, and recycling and to provide customers/consumers with appropriate information on its final destination.
In particular, based on Commission Decision 97/129/EC, packaging manufacturers and users are required to identify packaging material through specific coding, which characterizes its appropriate and correct disposal.
On November 21, 2022, Ministerial Decree No. 360 of September 28, 2022, was also published, adopting the Guidelines on environmental labeling for the correct fulfillment of packaging labeling obligations by the responsible parties.
In accordance with the principles of free movement of goods, the Guidelines emphasize the possibility of adopting digital channels that can completely replace or supplement the mandatory information directly on the packaging.
